In addition to the existing impaired driving legislation found within Canada’s Criminal Code, many provinces have enacted their own roadside sanction legislation.

Under Immediate Roadside Sanction (I.R.S.) programs, if a driver fails an alcohol breath test on an approved screening device, police can seize a driver’s license roadside, impound a vehicle roadside (even if it does not belong to the driver), and prohibit driving for a lengthy suspension period.
